When a third party illegitimately uses the distinctive marks or new creations of the owners without due authorization, a lawsuit may be filed before the Superintendence of Industry and Commerce or before the civil courts of the circuit in order for the infringer to cease immediate use of the previously acquired right and pay for the damages caused by using it illegally.

In this process, which may last from 1 to 2 years, the improper use of the acquired right and the damages caused must be demonstrated.
