El asunto enfrenta, como demandante, a la autora de la tesis titulada \u201cMariana de Austria en la encrucijada pol\u00edtica del siglo XVII\u201d, y, como demandado, al autor de la tesis titulada \u201cLa gobernaci\u00f3n de la monarqu\u00eda hisp\u00e1nica en la regencia de Mariana de Austria (1665-1675)\u00ab.<\/p>\n\n\n\n<p><em>(\u2026)<\/em><\/p>\n\n\n\n<p>Para dilucidar el asunto, el juzgado de primera instancia se\u00f1ala que se debe partir de dos elementos para su resoluci\u00f3n \u201ccuya concurrencia simult\u00e1nea es necesaria para la estimaci\u00f3n de la demanda, a saber: obra y autor\u00eda\u201d. Si falta alguno de estos elementos, la petici\u00f3n de condena del demandado deber\u00e1 desestimarse.<\/p>\n\n\n\n<p><em>(\u2026)<\/em><\/p>\n\n\n\n<p>Tras la valoraci\u00f3n anterior, recuerda el juzgado que las obras objeto de litigo son relativas a hechos hist\u00f3ricos, siendo los relatos que contienen no originales en s\u00ed mismos, por lo que no est\u00e1n protegidos por el derecho de autor, lo que s\u00ed est\u00e1 protegido es la plasmaci\u00f3n de tales hechos de forma original en una obra cient\u00edfica. Las pruebas periciales (coincidencias del 25%) aportadas por la demandante \u2013 realizadas por acad\u00e9micos \u2013 determinan que las coincidencias en el texto del demandado son \u201ctextos extra\u00eddos de manera literal de la tesis de la actora\u201d. Por ello, el juzgado entiende, que dado el importante grado de similitud confirmado, el demandado no habr\u00eda cumplido con el criterio de originalidad necesario para obtener el doctorado, y, por lo tanto, concluye que la tesis del demandado es un plagio de la tesis de la demandante.Por ello, el juzgado declara el plagio de la obra de la demandada por parte del autor demandado y condena a \u00e9ste como infractor de los derechos de propiedad intelectual de la demandante.
