{"id":10726,"date":"2025-05-06T16:48:35","date_gmt":"2025-05-06T21:48:35","guid":{"rendered":"https:\/\/provimarcas.com\/?p=10726"},"modified":"2025-05-07T12:16:32","modified_gmt":"2025-05-07T17:16:32","slug":"jorge-luna-pierde-disputa-legal-con-la-tinka-por-el-registro-de-su-nueva-marca-ante-indecopi","status":"publish","type":"post","link":"https:\/\/provimarcas.com\/en\/jorge-luna-pierde-disputa-legal-con-la-tinka-por-el-registro-de-su-nueva-marca-ante-indecopi\/","title":{"rendered":"JORGE LUNA PIERDE DISPUTA LEGAL CON LA TINKA POR EL REGISTRO DE SU NUEVA MARCA ANTE INDECOPI"},"content":{"rendered":"<p>La marca \u201cLa Yapita de No Hay Sin Suerte de Jorgitoluna.com\u201d fue rechazada por Indecopi, tras una oposici\u00f3n presentada por La Tinka, que aleg\u00f3 riesgo de confusi\u00f3n en entretenimiento.<\/p>\n\n\n\n<p>El comediante peruano\u00a0<strong>Jorge Luna<\/strong>, conocido por su programa\u00a0<a href=\"https:\/\/www.infobae.com\/peru\/2024\/08\/13\/hablando-huevadas-el-espectaculo-de-jorge-luna-y-ricardo-mendoza-que-rompe-todos-los-records-y-deja-millonarias-ganancias\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Hablando Huevadas<\/strong><\/a>, no podr\u00e1 registrar la marca\u00a0<strong>\u201cLa Yapita de No Hay Sin Suerte de Jorgitoluna.com\u201d<\/strong>\u00a0para servicios de entretenimiento, seg\u00fan una resoluci\u00f3n del\u00a0<strong>Instituto Nacional de Defensa de la Competencia y de la Protecci\u00f3n de la Propiedad Intelectual\u00a0<\/strong>(Indecopi). La raz\u00f3n es que el organismo consider\u00f3 que su marca pod\u00eda confundirse con las marcas de la loter\u00eda\u00a0<strong>La Tinka<\/strong>.<\/p>\n\n\n\n<p>La solicitud de&nbsp;<strong>Jorge Luna<\/strong>&nbsp;para registrar esta marca mixta, que inclu\u00eda servicios de entretenimiento, actividades deportivas y culturales (clase 41) y servicios de publicidad y gesti\u00f3n comercial (clase 35), fue presentada el 20 de marzo de 2024. Sin embargo, el 6 de mayo de 2024, la empresa&nbsp;<strong>La Tinka S.A.<\/strong>&nbsp;present\u00f3 una oposici\u00f3n a la solicitud, alegando que el t\u00e9rmino \u201cYapita\u201d formaba parte fundamental de tres de sus marcas registradas:&nbsp;<strong>YAPITA<\/strong>,&nbsp;<strong>YAPA<\/strong>&nbsp;y&nbsp;<strong>BOLIYAPA DE LA TINKA<\/strong>.<\/p>\n\n\n\n<p>La empresa argument\u00f3 que el nuevo signo de&nbsp;<strong>Jorge<\/strong>&nbsp;<strong>Luna<\/strong>&nbsp;podr\u00eda inducir a error a los consumidores, quienes podr\u00edan asociarlo con su propia marca, generando confusi\u00f3n.<\/p>\n\n\n\n<p>As\u00ed pues,&nbsp;<strong>LP Pasi\u00f3n por el Derecho<\/strong>&nbsp;otuvo la resoluci\u00f3n final de&nbsp;<strong>Indecopi,&nbsp;<\/strong>la cual determin\u00f3 que, efectivamente, hab\u00eda una coincidencia en el uso del t\u00e9rmino&nbsp;<strong>\u201cYapita\u201d<\/strong>, lo que generaba un&nbsp;<strong>riesgo de confusi\u00f3n<\/strong>&nbsp;en los consumidores, particularmente en la categor\u00eda de servicios de entretenimiento, ya que ambas marcas compet\u00edan en el mismo campo. A pesar de que&nbsp;<strong>Jorge<\/strong>&nbsp;<strong>Luna<\/strong>&nbsp;hab\u00eda incluido elementos adicionales en su marca, la entidad consider\u00f3 que eso no evitaba que el p\u00fablico pudiera asociarla con las marcas de&nbsp;<strong>La Tinka<\/strong>.<\/p>\n\n\n\n<p>En cuanto a la&nbsp;<strong>categor\u00eda 41<\/strong>, que incluye los servicios de entretenimiento,&nbsp;<strong>la oposici\u00f3n de La Tinka fue aceptada<\/strong>, y por eso se&nbsp;<strong>deneg\u00f3<\/strong>&nbsp;el registro de la marca del comediante en esta categor\u00eda. Esto significa que&nbsp;<strong>Jorge Luna<\/strong>&nbsp;no podr\u00e1 utilizar su marca para promocionar actividades de entretenimiento o culturales bajo el nombre \u201c<strong>La Yapita de No Hay Sin Suerte de Jorgitoluna.com<\/strong>\u201d.<\/p>\n\n\n\n<p>Sin embargo,&nbsp;<strong>Indecopi<\/strong>&nbsp;no encontr\u00f3 suficiente similitud entre las marcas&nbsp;<strong>\u201cYAPA\u201d<\/strong>&nbsp;y&nbsp;<strong>\u201cBOLIYAPA DE LA TINKA\u201d<\/strong>&nbsp;con la marca de&nbsp;<strong>Jorge<\/strong>&nbsp;<strong>Luna<\/strong>&nbsp;en la categor\u00eda de&nbsp;<strong>publicidad y gesti\u00f3n comercial<\/strong>&nbsp;(clase 35). Por lo tanto,&nbsp;<strong>la oposici\u00f3n en esta categor\u00eda fue rechazada<\/strong>, y el humorista pudo obtener el registro de su marca para&nbsp;<strong>servicios de publicidad y gesti\u00f3n comercial<\/strong>. Es decir, aunque no podr\u00e1 usar su marca para servicios de entretenimiento, s\u00ed podr\u00e1 usarla para actividades relacionadas con la&nbsp;<strong>gesti\u00f3n comercial<\/strong>&nbsp;y la&nbsp;<strong>publicidad<\/strong>. <\/p>\n\n\n\n<p>JORGE LUNA a\u00fan puede apelar<\/p>\n\n\n\n<p>Este fallo,&nbsp;<strong>emitido el 28 de marzo de 2025<\/strong>, es de&nbsp;<strong>primera instancia<\/strong>. Esto significa que&nbsp;<strong>Jorge<\/strong>&nbsp;<strong>Luna<\/strong>&nbsp;tiene la opci\u00f3n de apelar la decisi\u00f3n ante la&nbsp;<strong>Sala Especializada de Propiedad Intelectual del Indecopi<\/strong>, que podr\u00eda revisar el caso y tomar una nueva decisi\u00f3n. De ser apelado, se abrir\u00eda la posibilidad de una revisi\u00f3n m\u00e1s profunda del caso y de las pruebas presentadas.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Indecopi rechaz\u00f3 inscripci\u00f3n de Hablando Huevadas<\/h2>\n\n\n\n<p>En una pol\u00e9mica decisi\u00f3n,&nbsp;<strong>Indecopi<\/strong>&nbsp;deneg\u00f3 el registro de la marca&nbsp;<strong>\u201cHablando Huevadas\u201d<\/strong>, nombre del conocido programa de&nbsp;<strong>YouTube<\/strong>&nbsp;de&nbsp;<strong>Jorge Luna<\/strong>&nbsp;y&nbsp;<strong>Ricardo Mendoza<\/strong>. La resoluci\u00f3n argumenta que el t\u00e9rmino&nbsp;<strong>\u201cHUEVADAS\u201d<\/strong>&nbsp;es considerado&nbsp;<strong>vulgar y ofensivo&nbsp;<\/strong>por buena parte de la poblaci\u00f3n, raz\u00f3n por la cual se le califica como contrario a las buenas costumbres. Seg\u00fan el documento, la expresi\u00f3n alude a un \u201cdi\u00e1logo que merece rechazo y\/o que no merece importancia\u201d, lo que la convierte en inadecuada.<\/p>\n\n\n\n<p><strong>Indecopi<\/strong>&nbsp;tambi\u00e9n se\u00f1al\u00f3 que el contenido del programa, destinado a un p\u00fablico general que incluye j\u00f3venes y ni\u00f1os, contradice los objetivos educativos que deben primar en esos segmentos. Por ello, aplic\u00f3 el art\u00edculo 135, literal p), de la&nbsp;<strong>Decisi\u00f3n 486<\/strong>&nbsp;sobre&nbsp;<strong>Industrial Property<\/strong>, que proh\u00edbe registrar marcas que contravengan la moral, el orden p\u00fablico o las buenas costumbres.<\/p>\n\n\n\n<p>Este mismo criterio fue utilizado en 2008 para rechazar la marca&nbsp;<strong>\u201cEl Pezweon\u201d<\/strong>, creaci\u00f3n de&nbsp;<strong>Carlos Banda<\/strong>&nbsp;y&nbsp;<strong>Andrea Tataje<\/strong>.
