{"id":11810,"date":"2025-07-08T09:25:04","date_gmt":"2025-07-08T14:25:04","guid":{"rendered":"https:\/\/provimarcas.com\/?p=11810"},"modified":"2025-07-08T09:25:50","modified_gmt":"2025-07-08T14:25:50","slug":"popsy-no-pudo-evitar-que-la-sic-le-concediera-el-registro-a-uno-wellness-en-el-mercado","status":"publish","type":"post","link":"https:\/\/provimarcas.com\/en\/popsy-no-pudo-evitar-que-la-sic-le-concediera-el-registro-a-uno-wellness-en-el-mercado\/","title":{"rendered":"POPSY NO PUDO EVITAR QUE LA SIC LE CONCEDIERA EL REGISTRO A UNO WELLNESS EN EL MERCADO"},"content":{"rendered":"<p><em>La Super Intendencia de Industria y Comercio&nbsp;&nbsp;desestim\u00f3 la oposici\u00f3n de Popsy porque el signo solicitado no incurr\u00eda en ninguna causal de irregistrabilidad.<\/em><\/p>\n\n\n\n<p>En un pleito de marca en la Superintendencia de Industria y Comercio, SIC, Comercial Allan, m\u00e1s conocida bajo la reconocida marca de helados Popsy, tuvo una derrota amarga contra Uno Wellness, un signo registrado en la clase 41 de la Clasificaci\u00f3n Internacional de Niza que ofrece servicios de acondicionamiento f\u00edsico.<\/p>\n\n\n\n<p>Aunque el enfrentamiento entre ambos signos inici\u00f3 porque la compa\u00f1\u00eda de helados Gourmet se opuso al registro de Uno Wellness, pues replic\u00f3 la expresi\u00f3n de su marca registrada \u201cPopsy Wellness\u201d y representaba as\u00ed un riesgo latente de confusi\u00f3n en el mercado, el \u00f3rgano de control desestim\u00f3 este argumento ya que en otros aspectos las empresas pod\u00edan diferenciarse sin ning\u00fan problema.<\/p>\n\n\n\n<p>La direcci\u00f3n del ente de control recalc\u00f3 que como uno de los requisitos para que un signo pueda ser registrado como marca es que \u00e9ste cuente con distintividad, y en este caso exist\u00eda, no hab\u00eda motivo alguno para evitar la solicitud realizada.<\/p>\n\n\n\n<p>Sobre el uso de la palabra \u201cWellness\u201d, la SIC se\u00f1al\u00f3 que la compa\u00f1\u00eda solicitante no incurri\u00f3 en ninguna causal de irregistrabilidad, ya que las expresiones de la marca solicitada no pod\u00edan analizarse de forma individual, sino en conjunto, pues pose\u00eda, de forma congruente, un significado que alud\u00eda al sentimiento de bienestar que pretende ofrecer con los servicios de la clase 41.<\/p>\n\n\n\n<p>Teniendo en cuenta que Popsy es una empresa que se dedica a la creaci\u00f3n y distribuci\u00f3n de helados y Uno Wellness a la entrega de experiencias relacionadas con actividades f\u00edsicas como el yoga o pilates, el \u00f3rgano de control concluy\u00f3 dentro de su an\u00e1lisis que las posibilidades de asociaci\u00f3n entre ambos signos era pr\u00e1cticamente nula.<\/p>\n\n\n\n<p>Esto, debido a que \u201cno es razonablemente probable que compartan los mismos canales de comercializaci\u00f3n, medios publicitarios y promocionales o que se predique su uso conjunto, por lo que no se observa un riesgo de confusi\u00f3n en el consumidor\u201d, asegur\u00f3 la SIC.<\/p>\n\n\n\n<p>Edgar Iv\u00e1n Le\u00f3n Robayo, abogado y docente de la Universidad Sergio Arboleda explic\u00f3 que, como la causal de irregistrabilidad se predica no solo de la identidad de las expresiones confrontadas, sino del producto que se cubre con la marca, no hab\u00eda razones para evitar negar la solicitud expuesta.<\/p>\n\n\n\n<p>Informaci\u00f3n tomada de: Asuntos Legales <a href=\"https:\/\/www.asuntoslegales.com.co\/pleitos\/popsy-no-pudo-evitar-que-la-sic-le-concediera-el-registro-a-uno-wellness-en-el-mercado-4171005\">https:\/\/www.asuntoslegales.com.co\/pleitos\/popsy-no-pudo-evitar-que-la-sic-le-concediera-el-registro-a-uno-wellness-en-el-mercado-4171005<\/a><\/p>\n\n\n\n<p>#LaSuperintendenciadeIndustriayComercio #Marcas #SIC #Popsy #pleitodemarcas #empresas <\/p>","protected":false},"excerpt":{"rendered":"<p>La Super Intendencia de Industria y Comercio&nbsp;&nbsp;desestim\u00f3 la oposici\u00f3n de Popsy porque el signo solicitado no incurr\u00eda en ninguna causal de irregistrabilidad.
