Es recurrente ver en el despacho del \u00f3rgano de control sus objeciones a registros y esta vez frustr\u00f3 la marca Caf\u00e9 Planadas.<\/p>\n\n\n\n<p>Edward Leandro Frasica, representante legal de la marca solicitada, pretend\u00eda producir y comercializar productos relacionados con las bolsas de filtro para el caf\u00e9, para la clase 30 de la Clasificaci\u00f3n Internacional de Niza.<\/p>\n\n\n\n<p>Como en su denominaci\u00f3n, la expresi\u00f3n solicitada hizo uso de la expresi\u00f3n \u201cCaf\u00e9\u201d y \u201cPlanadas\u201d , una zona del Tolima, para referirse a una ubicaci\u00f3n geogr\u00e1fica de la que es oriundo el producto, la Fedecaf\u00e9 argument\u00f3 que el registro no pod\u00eda ser concedido porque pod\u00eda confundirse con su marca registrada Caf\u00e9 de Tolima.<\/p>\n\n\n\n<p>Como el segmento competitivo de ambos signos tambi\u00e9n era similar, el gremio cafetero asegur\u00f3 que las posibilidades de confusi\u00f3n eran altas.<\/p>\n\n\n\n<p>\u201cLos productos que pretende identificar la marca solicitante resultan compartir una clara conexidad competitiva con los productos protegidos por la Denominaci\u00f3n de Origen Caf\u00e9 de Tolima\u201d, se\u00f1al\u00f3 la defensa del gremio.<\/p>\n\n\n\n<p>Ante la oposici\u00f3n, Frasica no dio respuesta alguna, por lo que el \u00f3rgano de control procedi\u00f3 a realizar su an\u00e1lisis de irregistrabilidad.<\/p>\n\n\n\n<p>All\u00ed, la Superindustria se\u00f1al\u00f3 que, como en el mercado ya exist\u00eda una marca denominada Racaf\u00e9 Planadas, y ofrec\u00eda los mismos servicios que el signo solicitado, no era posible proceder con su autorizaci\u00f3n, pues podr\u00eda generar confusi\u00f3n en el consumidor.
