La decisi\u00f3n se fundament\u00f3 en el riesgo de confusi\u00f3n con marcas preexistentes.<\/em><em><\/em><\/p>\n\n\n\n<p><em>En agosto de 2024, An Fu Ce Link Limited solicit\u00f3 el registro de la marca para productos como m\u00e1quinas de limpieza el\u00e9ctricas , dispositivos electr\u00f3nicos, aparatos de iluminaci\u00f3n y utensilios dom\u00e9sticos. La empresa Genfar S.A. present\u00f3 oposici\u00f3n espec\u00edfica para la clase 9, argumentando que \u201cHinen\u201d podr\u00eda confundirse fon\u00e9tica y gr\u00e1ficamente con su marca registrada \u201cHigen por Genfar\u201d, destinada a productos electr\u00f3nicos similares.<\/em><em><\/em><\/p>\n\n\n\n<p><em>Durante el examen de registro, la SIC identific\u00f3 un antecedente m\u00e1s relevante: la marca nominativa Heinen, solicitada el 12 de marzo de 2024 por Heinen GmbH &amp; Co. KG. Esta marca cubre dispositivos electr\u00f3nicos para la industria alimentaria (clase 9), equipos de refrigeraci\u00f3n (clase 11) y servicios de ingenier\u00eda (clase 42), anterior a la solicitud de \u201cHinen\u201d.<\/em><em><\/em><\/p>\n\n\n\n<p><em>(\u2026)<\/em><em><\/em><\/p>\n\n\n\n<p><em>La SIC declar\u00f3 infundada la oposici\u00f3n de Genfar S.A. para la clase 9, considerando insuficiente el conflicto con Higen.&nbsp;Sin embargo, deneg\u00f3 el registro de \u201cHinen\u201d en todas las clases solicitadas por riesgo de confusi\u00f3n con Heinen, aplicando el Art\u00edculo 136 de la Decisi\u00f3n 486 de la Comunidad Andina.
