Un nuevo varapalo judicial azota a la empresa californiana, esta vez en favor de una espa\u00f1ola.<\/em><\/p>\n\n\n\n<p><em>Un jurado federal de Delaware en Estados Unidos ha condenado a Apple a pagarle a la empresa espa\u00f1ola TOT Power Control un total de 110,7 millones de d\u00f3lares, unos 93,3 millones de euros por infringir una patente basada en tecnolog\u00edas de comunicaciones inal\u00e1mbricas.\u201d<\/em><\/p>\n\n\n\n<p><em>Seg\u00fan expone el propio jurado, los principales dispositivos de Apple incluyendo los iPhone, los iPad y los Apple Watch violaban patentes de TOT Power Control respecto a las tecnolog\u00edas usadas en los est\u00e1ndares 3G. Apple ya ha negado la acusaci\u00f3n y ha anunciado una apelaci\u00f3n.<\/em><\/p>\n\n\n\n<p><em>La demanda se remonta a 2021, cuando TOT Power Control, compa\u00f1\u00eda afincada en Madrid, demand\u00f3 a Apple acusando a la empresa de la manzana de infringir sus patentes. Concretamente, explicaban que algunos de sus dispositivos inclu\u00edan transmisores que usaban estas patentes.<\/em><\/p>\n\n\n\n<p><em>Obviamente, estos transmisores, en palabras de TOT Power Control, habr\u00edan usado patentes registradas previamente en Estados Unidos sin permiso expreso de Apple. El pasado martes 1 de julio, el jurado estadounidense acab\u00f3 por condenar a Apple, considerando probado el hecho delictivo.<\/em><\/p>\n\n\n\n<p><em>Ahora, bajo esta premisa legal, Apple deber\u00e1 pagar royalties a TOT Power Control por un valor total de 110,7 millones de d\u00f3lares, lo que al cambio supone m\u00e1s de 93 millones de euros. Apple ya ha contraargumentado que las patentes eran totalmente inv\u00e1lidas.<\/em><\/p>\n\n\n\n<p><em>En la demanda, el responsable de TOT Power Control \u00c1lvaro L\u00f3pez-Medrano relat\u00f3 que los procesos de control de energ\u00eda practicados &#8220;por los procesadores de banda inal\u00e1mbrica que emplean los dispositivos m\u00f3viles de Apple para acceder y operar redes celulares&#8221; eran el foco de las infracciones.<\/em><\/p>\n\n\n\n<p><em>Este no es el \u00fanico litigio en el que est\u00e1 metida TOT Power Control por cuestiones parecidas. En el mismo juzgado de Delaware se han presentado demandas parecidas, contra fabricantes como Samsung o LG, aunque estas est\u00e1n pendientes de resoluci\u00f3n.<\/em><\/p>\n\n\n\n<p><em>Est\u00e1 por ver si el jurado acepta la apelaci\u00f3n de Apple o si por el contrario la sentencia es determinante.
