{"id":14048,"date":"2026-01-30T07:48:38","date_gmt":"2026-01-30T12:48:38","guid":{"rendered":"https:\/\/provimarcas.com\/?p=14048"},"modified":"2026-03-09T15:40:54","modified_gmt":"2026-03-09T20:40:54","slug":"consejo-de-estado-ratifica-proteccion-de-derechos-a-las-herederas-de-frida-kahlo","status":"publish","type":"post","link":"https:\/\/provimarcas.com\/en\/consejo-de-estado-ratifica-proteccion-de-derechos-a-las-herederas-de-frida-kahlo\/","title":{"rendered":"CONSEJO DE ESTADO RATIFICA PROTECCI\u00d3N DE DERECHOS A LAS HEREDERAS DE FRIDA KAHLO"},"content":{"rendered":"<p><em>El \u00f3rgano estatal ratific\u00f3 la decisi\u00f3n de la SIC de negar el registro del nombre &#8220;Frida Kahlo&#8221; como marca a una corporaci\u00f3n<\/em><\/p>\n\n\n\n<p>El Consejo de Estado de Colombia confirm\u00f3 la legalidad de las resoluciones de la Superintendencia de Industria y Comercio que negaron el registro de la marca &#8220;Frida Kahlo&#8221; a la sociedad Frida Kahlo Corporation.<\/p>\n\n\n\n<p>La corporaci\u00f3n pretend\u00eda obtener la titularidad de este signo para distinguir diversos productos y servicios pertenecientes a las clases 14, 18, 21, 24, 25, 28, 35, 38 y 41 de la Clasificaci\u00f3n Internacional de Niza. Entre los art\u00edculos que se buscaba amparar se encontraban joyas, prendas de vestir, calzado, juguetes, art\u00edculos de cuero y servicios de entretenimiento.<\/p>\n\n\n\n<p>La Sala de lo Contencioso Administrativo determin\u00f3 que los signos nominativos solicitados son id\u00e9nticos al nombre y apellido de la artista mexicana. Seg\u00fan el fallo, la ausencia de elementos adicionales que permitan diferenciar la marca del nombre de la persona natural genera un riesgo de confusi\u00f3n en el p\u00fablico consumidor. El tribunal consider\u00f3 que el registro sin distintivos extra afectar\u00eda la identidad de una figura reconocida en el mercado art\u00edstico y cultural.<\/p>\n\n\n\n<p>En el proceso se estableci\u00f3 que no exist\u00eda un consentimiento vigente o autorizaci\u00f3n expresa por parte de las herederas leg\u00edtimas para que la demandante solicitara dichos registros.<\/p>\n\n\n\n<p>Por el contrario, Mar\u00eda Cristina Teresa Romeo Pinedo y Mara de Anda Romeo presentaron oposici\u00f3n formal alegando la falta de aval para el uso del nombre e imagen de la pintora. La corporaci\u00f3n demandante aleg\u00f3 poseer un contrato de asociaci\u00f3n exclusivo desde 2005, pero la vigencia y el alcance de dicho acuerdo han sido objeto de controversias judiciales en otros pa\u00edses.<\/p>\n\n\n\n<p>El Consejo de Estado aplic\u00f3 el art\u00edculo 136, literal e), de la Decisi\u00f3n 486 de la Comisi\u00f3n de la Comunidad Andina, el cual proh\u00edbe el registro de signos que afecten la identidad o prestigio de personas naturales sin el debido permiso.<\/p>\n\n\n\n<p>La corporaci\u00f3n tambi\u00e9n argument\u00f3 la existencia de una familia de marcas previa en Colombia, pero el alto tribunal desestim\u00f3 esta tesis al encontrar que solo pose\u00edan tres registros previos, cantidad insuficiente para consolidar dicha figura jur\u00eddica.<\/p>\n\n\n\n<p>Finalmente, la sentencia precisa que la oficina de registro nacional no tiene la obligaci\u00f3n de otorgar concesiones autom\u00e1ticas basadas en registros obtenidos en otros pa\u00edses.<\/p>\n\n\n\n<p>Cada examen de registrabilidad debe ser aut\u00f3nomo y ajustarse a la normativa comunitaria vigente para proteger los derechos de terceros.
