Por lo tanto, la expresi\u00f3n \u201cexceso de\u201d, obligatoria en las etiquetas de bebidas alcoh\u00f3licas, en los t\u00e9rminos del art\u00edculo 16 de la Ley 1816\/16, satisface el est\u00e1ndar de aquello que debe comunicarse al consumidor, por lo que resulta exequible. As\u00ed lo indic\u00f3 la Corte Constitucional en la Sentencia C-445 del 2025, cuyo texto completo public\u00f3 recientemente.<\/p>\n\n\n\n<p>El alto tribunal concluy\u00f3 que en este caso la referencia al exceso funciona como un elemento clave, l\u00edmite y definitorio de una pol\u00edtica p\u00fablica en materia de etiquetado cuyo objeto es enviar un mensaje al consumidor sobre aquello que resulta perjudicial para su salud y que, por lo tanto, el Estado debe informar para prevenir y desincentivar. (Lea: La expresi\u00f3n \u2018exceso de\u2019, relacionada con el consumo de alcohol, no desconoce derechos de los consumidores)<\/p>\n\n\n\n<p>En esa medida, agreg\u00f3, el legislador determin\u00f3 como imperativo legal advertir sobre las consecuencias del exceso de alcohol y, en cambio, estim\u00f3 que todo lo que est\u00e9 por debajo de ese umbral no debe incorporarse en la etiqueta. Lo anterior debido a que, entre otras razones, (i) no hay evidencia de que el consumo sea da\u00f1oso o que, (ii) incluso, si hay evidencia de alg\u00fan riesgo, es de aquellos que son tolerables.<\/p>\n\n\n\n<p>De otra parte, la Sala reconoci\u00f3 que la etiqueta de advertencia est\u00e1 dirigida a una poblaci\u00f3n en particular, las personas adultas a quienes el consumo de alcohol les es permitido y que tambi\u00e9n tienen deberes de autoprotecci\u00f3n. Por lo tanto, no puede afirmarse que la etiqueta actual sea enga\u00f1osa.<\/p>\n\n\n\n<p>En todo caso, si bien se declar\u00f3 la exequibilidad, se exhort\u00f3 al Congreso y al Ministerio de Salud para que, en el marco de sus competencias, actualizar la pol\u00edtica p\u00fablica sobre consumo de alcohol conforme a la mejor evidencia cient\u00edfica. As\u00ed mismo, se llam\u00f3 a todas las instituciones competentes a implementar medidas intersectoriales y educativas para reducir el consumo de alcohol y garantizar una informaci\u00f3n veraz sobre sus riesgos (M.
