Seg\u00fan Andr\u00e9s Rojas Herrera, asociado de derecho de autor y entretenimiento en OlarteMoure, dijo que\u00a0<strong>si una empresa desea utilizar una canci\u00f3n en sus publicaciones de TikTok, debe asegurarse de que la canci\u00f3n est\u00e9 incluida en los cat\u00e1logos autorizados de la plataforma.<\/strong>\u00a0\u201cEn caso de que la canci\u00f3n no est\u00e9 dentro de un cat\u00e1logo autorizado, se debe obtener autorizaci\u00f3n del titular de los derechos, mediante una licencia de sincronizaci\u00f3n\u201d, explica Rojas.La falta de cumplimiento con los derechos de autor puede tener consecuencias severas. Seg\u00fan el art\u00edculo 271 del C\u00f3digo Penal, la pena por violaci\u00f3n de los derechos patrimoniales de autor oscila entre cuatro a ocho a\u00f1os de prisi\u00f3n<strong>\u00a0y multas significativas, que van desde 26,66 a 1.000 salarios m\u00ednimos legales mensuales vigentes.
