APPEALS COURT RULING REVIVES SENIOR LIVING TRADEMARK LAWSUIT

“A trademark infringement lawsuit pitting two senior living operators against each other over the name of a community has had new life breathed into it after an appellate court vacated an earlier ruling, allowing the case to proceed.
On Tuesday, the US Court of Appeals for the 4th Circuit vacated a 2023 ruling that found in favor of Retirement Unlimited Inc., which had been sued by Westmont Living over RUI’s naming of a Richmond, VA, community that Westmont argued would create consumer confusion.”
